Territory
The geographic area outlined in the license agreement within whose limits the licensee is permitted to sell licensed merchandise.
Trade Dress
Refers to the visual appearance of a product or its packaging that signify the source of the product to the consumers. Trade dress is a form of intellectual property.
Trade Name
Also known as a trading name or a business name, this is the title under which a business trades for commercial purposes, although its registered, legal name, used for contracts and other formal situations, may be different.
Trademark "™"
A distinctive sign or indicator used by an individual, business organization, or other legal entity to identify that the products or services on which the trademark appears originate from a unique source. The trademark distinguishes its products and services from those of other entities.
Trademark and Copyright Infringement
A violation of the exclusive rights attached to a trademark or copyright. Infringement may occur when one party, the "infringer," uses a trademark which is identical or confusingly similar to a trademark owned by another party, in relation to products or services which are identical or similar to the products or services which the registration covers. An owner of a trademark may commence legal proceedings against a party which infringes its registration.
